SquashPal Terms of Service

Improve your squash game with instant video analysis from SquashPal. These Terms of Service (the “Terms”) govern your access to and use of the SquashPal mobile application, website, and related services (collectively, the “Service”). Please read them carefully before using the Service.

By creating an account, downloading or using the SquashPal app, uploading squash videos, or otherwise accessing the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

These Terms form a binding agreement between you and SquashPal regarding your use of the Service. By accessing or using the Service in any way, you:

  • Confirm that you have read, understood, and agree to be bound by these Terms;
  • Represent that you are at least the age of majority in your jurisdiction or have the consent of a parent or legal guardian to use the Service; and
  • Agree to comply with all applicable laws and regulations when using the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and “you” in these Terms will refer to both you as an individual and that organization.

2. Description of Service

SquashPal is a video analysis coaching tool specifically for squash players. The Service allows you to upload squash match or practice videos, which are then analyzed using artificial intelligence to provide personalized coaching feedback, including identified focus areas, ranked priorities for improvement, and suggested practice plans.

The core experience is simple: upload your squash video, receive instant, personalized coaching advice, and use that guidance to improve your game. SquashPal is designed to make coaching more accessible and convenient by delivering insights directly to your mobile device, without requiring live coaching sessions.

Features of the Service may include, but are not limited to:

  • Uploading and storing squash video clips for analysis;
  • Automated AI analysis of technique, movement, and gameplay patterns based on uploaded videos;
  • Personalized feedback, including suggested focus areas and ranked priorities for improvement;
  • Practice plans and drills tailored to your identified needs; and
  • Basic usage analytics and history of your analyzed videos.

From time to time, SquashPal may offer promotions, such as a free initial analysis. The first analysis being free does not create any obligation for SquashPal to provide additional services without charge. We reserve the right to modify or discontinue promotional offers at any time.

We may add, change, or remove features over time in order to improve the Service. Certain features may be offered as part of paid plans or subscriptions. Your use of such features may be subject to additional terms, which will be presented at the time of purchase or subscription.

3. User Accounts

To access some or all parts of the Service, you may be required to create a user account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and promptly update your information to keep it accurate and complete; and
  • Maintain the confidentiality of your login credentials and not share them with others.

You are responsible for all activities that occur under your account, whether or not authorized by you. If you become aware of any unauthorized use of your account, you must notify us promptly at the contact information provided below.

SquashPal reserves the right to refuse registration, cancel accounts, or reclaim usernames if we believe they violate these Terms or pose a risk to the security or integrity of the Service.

4. User Content (Video Uploads)

The Service allows you to upload, store, and transmit content, including squash match and practice videos, comments, and other materials (“User Content”). You retain all rights in and to your User Content, subject to the rights granted to SquashPal in these Terms.

By uploading or otherwise providing User Content through the Service, you represent and warrant that:

  • You own the User Content or have all necessary rights and permissions to upload it and to grant the rights described in these Terms;
  • Your User Content does not infringe, misappropriate, or violate any third-party rights, including intellectual property, privacy, or publicity rights; and
  • Your User Content complies with these Terms and with all applicable laws and regulations.

You grant SquashPal a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, modify (for technical purposes, such as compression, optimization, or processing), analyze, and create derivative works from your User Content solely for the purpose of operating, improving, and providing the Service, including training, testing, and refining our AI models and coaching features.

Where required by law, we will take steps to de-identify or aggregate User Content used for research or model improvement. We will handle personal information contained in User Content in accordance with our Privacy Policy.

You are solely responsible for backing up your User Content. SquashPal does not guarantee that User Content will be available or retrievable at all times, and we are not responsible for any loss or corruption of User Content.

5. Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to the app, website, software, algorithms, AI models, coaching logic, design, text, graphics, logos, trademarks, and other content (excluding User Content), are and will remain the exclusive property of SquashPal and its licensors.

Except for the limited rights expressly granted to you in these Terms, no rights are granted to you by implication, estoppel, or otherwise. Subject to your compliance with these Terms, SquashPal grants you a limited, non-exclusive, non-transferable, revocable license to download and use the SquashPal mobile application on a device that you own or control, solely for your personal, non-commercial use to analyze and improve your squash performance.

You may not use any SquashPal trademarks, logos, or branding without our prior written permission. Any feedback, suggestions, or ideas you provide about SquashPal or the Service (“Feedback”) may be used by us without any obligation to you. You agree that SquashPal will own all rights in and to any improvements or modifications to the Service based on such Feedback.

6. Prohibited Uses

You agree to use the Service only for lawful purposes and in a way that is consistent with the empowering, coaching-focused nature of SquashPal. Without limiting the generality of the foregoing, you agree that you will not:

  • Upload, post, transmit, or otherwise make available any User Content that is unlawful, harmful, harassing, defamatory, obscene, hateful, discriminatory, or otherwise objectionable;
  • Upload videos or other content that contain nudity, sexual content, extreme violence, or other content that is unrelated to squash or inappropriate for a coaching environment;
  • Upload videos of other individuals without their permission, or in violation of their privacy or publicity rights;
  • Use the Service to stalk, harass, threaten, or harm any person;
  • Attempt to gain unauthorized access to the Service, other users’ accounts, or any related systems or networks;
  • Interfere with or disrupt the integrity or performance of the Service, including by introducing viruses, malware, or other harmful code;
  • Reverse engineer, decompile, translate, or otherwise attempt to derive the source code of any part of the Service, except as expressly permitted by law;
  • Use any automated system, including bots, scrapers, or crawlers, to access the Service in a manner that sends more request messages to the Service than a human can reasonably produce in the same period using a conventional online web browser or mobile app; or
  • Use the Service for any commercial coaching service, resale, or other exploitation not expressly authorized by SquashPal.

We reserve the right, but do not have an obligation, to review, monitor, or remove User Content at our sole discretion if we believe it violates these Terms or may harm the Service or other users.

7. Disclaimers

SquashPal is designed to support and enhance your squash training by providing AI-powered insights and personalized coaching suggestions. However, the Service is not a substitute for professional, in-person coaching, medical advice, or individualized athletic training programs.

You understand and agree that:

  • The AI analysis and recommendations are based solely on the videos and data you provide and may not capture all aspects of your technique, physical condition, or playing environment;
  • Any coaching advice, practice plans, or suggested priorities are informational only and are not guaranteed to improve your performance or prevent injury;
  • You are responsible for using your own judgment and, where appropriate, consulting a qualified coach, trainer, or medical professional before making changes to your training or physical activity; and
  • You should always warm up properly, train within your limits, and seek professional guidance if you have injuries, health conditions, or concerns about your fitness to play.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SquashPal does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or any related systems are free of viruses or other harmful components. We make no guarantee regarding the accuracy, completeness, or reliability of any analysis, coaching advice, or results obtained through the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will SquashPal or its affiliates, officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the Service;
  • Any conduct or content of any third party on or through the Service;
  • Any content obtained from the Service, including AI-generated analysis or coaching advice; or
  • Unauthorized access, use, or alteration of your transmissions or User Content.

To the maximum extent permitted by law, SquashPal’s total liability for any claim arising out of or relating to these Terms or the Service will be limited to the greater of (a) the amount you paid to SquashPal for use of the Service during the six (6) months prior to the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, so some of the above limitations may not apply to you. In such cases, SquashPal’s liability will be limited to the fullest extent permitted by applicable law.

9. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you use the Service, including information in your account, your usage data, and any personal data contained within your uploaded videos.

By using the Service, you acknowledge that you have reviewed our Privacy Policy and agree that SquashPal may collect, use, and share your information as described in that policy. If you do not agree with the Privacy Policy, you must stop using the Service.

We encourage you to review your device and account privacy settings and to be mindful of the personal information you include in your video uploads. Do not upload videos that contain sensitive personal information that you do not wish to share or that belong to others without their consent.

10. Changes to Terms

We may update or modify these Terms from time to time. When we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms in the app or on our website, updating the “Effective date” above, or sending an email or in-app notice.

Your continued use of the Service after the updated Terms have become effective constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

11. Governing Law

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be governed by and construed in accordance with the laws of the jurisdiction in which SquashPal is organized, without giving effect to any choice or conflict of law provision or rule. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms or your use of the Service.

Subject to any mandatory provisions of applicable law, you and SquashPal agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any dispute arising out of or relating to these Terms or the Service, and you waive any objection to venue or jurisdiction on the grounds of inconvenient forum or otherwise.
