SquashPal Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Hephaestus Ventures LLC (“SquashPal”, “we”, “us”), the company that operates the SquashPal mobile app, the squashpal.app website, and related services (together, the “Service”).

By creating an account, downloading or using the app, uploading videos, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

If you installed the app from the Apple App Store, your use of the app is also governed by Apple’s standard Licensed Application End User License Agreement (“Apple EULA”): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms apply in addition to the Apple EULA and cover things it does not, such as the website and your account. Nothing in these Terms takes away any rights the Apple EULA gives you.

1. Who can use SquashPal You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the Service. SquashPal is not intended for children under 13.

2. What the Service does SquashPal is a video analysis coaching tool for squash players. You upload squash match or practice videos, and the Service uses artificial intelligence to create personalized coaching feedback, such as identified focus areas, ranked priorities for improvement, and suggested practice plans.

From time to time we may offer promotions, such as a free first analysis. A free first analysis does not create any obligation to provide additional services without charge, and we may modify or discontinue promotional offers at any time.

We may add, change, or remove features over time in order to improve the Service.

3. Accounts When you create an account, you agree to provide accurate, current, and complete information, keep it up to date, and keep your login credentials confidential. You are responsible for all activity that happens under your account. If you believe someone has used your account without permission, tell us right away using the contact details below.

We may refuse registration or cancel an account if we believe it violates these Terms or puts the security or integrity of the Service at risk.

4. Subscriptions and payments Your first analysis is free. SquashPal Pro is an optional auto-renewing subscription that unlocks more analyses each billing period:

  • SquashPal Pro Monthly: $9.99 per month
  • SquashPal Pro Yearly: $59.99 per year

Prices are in US dollars and may vary by country. Payment is charged to your Apple Account when you confirm the purchase. Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.

You can manage or cancel your subscription anytime in your Apple Account settings. Apple handles all billing and refund requests for subscriptions purchased in the app and governs them under its own terms. Deleting your SquashPal account does not cancel your subscription.

5. Your videos and other content The Service lets you upload squash videos and other materials (“Your Content”). You keep all rights to Your Content.

By uploading Your Content, you confirm that you own it or have the necessary rights and permissions, including permission from anyone appearing in a video you upload, and that it does not violate anyone’s rights or any law.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical purposes (such as compression and optimization), and analyze Your Content solely to operate and provide the Service — for example, to create your coaching reports. We do not use Your Content to train AI models, and we do not sell it. We handle personal information in Your Content as described in our Privacy Policy.

You are responsible for keeping your own backup of Your Content. We do not guarantee that uploaded videos will always be available or retrievable.

6. AI-generated feedback Coaching reports are created by third-party AI models. Before your first analysis, we ask for your permission in the app to send the data needed for analysis, and you can withdraw it anytime in Profile → Data and AI.

AI feedback is informational only. It is generated automatically, may be incomplete or inaccurate, and is not a substitute for professional, in-person coaching, medical advice, or individualized training programs. Use your own judgment, consult a qualified coach or medical professional where appropriate, warm up properly, and train within your limits.

7. Acceptable use You agree not to:

  • upload content that is unlawful, harmful, harassing, defamatory, obscene, hateful, or otherwise objectionable;
  • upload nudity, sexual content, extreme violence, or content unrelated to squash;
  • upload videos of other people without their permission;
  • use the Service to stalk, harass, threaten, or harm anyone;
  • attempt to gain unauthorized access to the Service or other users’ accounts;
  • interfere with or disrupt the Service, including by introducing malware or sending excessive automated requests;
  • reverse engineer the Service except as permitted by law;
  • resell, sublicense, or run a commercial coaching service on top of the Service without our written permission.

We may review and remove content that we believe violates these Terms or harms the Service or other users.

8. Intellectual property The Service — including the app, website, software, AI models, coaching logic, design, text, graphics, logos, and trademarks — is owned by Hephaestus Ventures LLC or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use.

You may not use SquashPal branding without our prior written permission. If you send us feedback or suggestions, you agree we may use them to improve the Service without obligation or compensation to you.

9. Privacy Our Privacy Policy at https://squashpal.app/privacy-policy/ explains what we collect, how we use it, and the choices you have. By using the Service you acknowledge it. Please be mindful of the personal information in your videos, and do not upload videos of others without their consent.

10. Disclaimers TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, and we make no guarantee about the accuracy, completeness, or reliability of any analysis or coaching advice.

11. Limitation of liability To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the Service is limited to the greater of (a) what you paid us for the Service in the six months before the claim, or (b) USD $100.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

12. Changes to these Terms We may update these Terms from time to time. When we make material changes, we will take reasonable steps to notify you, such as a notice in the app or on the website, and we will update the effective date above. If you keep using the Service after changes take effect, you accept the updated Terms. If you do not agree, stop using the Service.

13. Governing law These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You and we agree to the exclusive jurisdiction of the state and federal courts located in Monroe County, Indiana, for any dispute arising out of these Terms or the Service, except where local consumer protection law gives you the right to bring a claim elsewhere.
